Dear Ms. Seer,

It has come to our attention that you are in dispute of our revocation of your worker’s compensation[a][b] benefits. We take these matters very seriously and wish to resolve this issue in the most expedient way possible. I am writing this letter on behalf of Mr. McKay in order to clarify any misunderstandings that may have arisen.

According to our records, you sustained a work-related injury on the 28th of August; strained wrist tendons, and a sprained elbow. Due to the nature of your injuries, you were unable to perform your job duties, and were subsequently granted worker’s compensation[c].

As per your doctor’s instructions, you were put on a treatment schedule of 6-7 weeks which included a prescription of pain-killers and physical therapy[d]. Additionally, it was recommended you perform no pulling, bending at the waist, carrying, lifting, or reaching above the shoulders.

We understand you are part owner of a bar in which you help operate on nights and weekends. We have strong reason to believe you have been carrying out activities that were specifically recommended against by your doctor. Additionally, you have been earning an income while performing these tasks.

Under state law, you are required to report any supplemental income you may receive while earning worker’s compensation. You have also been performing tasks that are similar to your job duties at MedTech. As per company policy, we have decided to revoke your compensation benefits, as you are in direct violation of state law. In light of this, we would also like to bring to your attention the stated “release to full duty” of your doctor of October 20th, of which we are now nearly three months past.

MedTech values your skills and contributions to the company, and we wish to retain you. However[e], any legal action against the company regarding the reinstatement of your compensation benefits may jeopardize any future prospects of your return to your current position[f].

Please contact me as soon as possible so we may begin to make future arrangements with regard to compensation and further employment with the company.

Sincerely,

Aaron Trifunac[g]

MedTech Worker’s Compensation Policy

The following memo will be covering current MedTech worker’s compensation policies as well as a basic overview of current company policy regarding work-related injuries[h].

Before addressing specific company policies regarding compensation due to work related injuries, we would like all employees of MedTech to know that our primary goal as a company is to keep all of our workers safe and happy[i]. It is essential that you feel you feel comfortable coming in every day to put in an honest day’s work without feeling fear of neglect from the company. That being said, in the event of a work-related accident, there are guidelines that should be followed in order to ensure you are protected financially or otherwise[j].
