INTRODUCTION
Trade union is an association that exists to overcome problems faced by labourers. It is an association made up together mainly by workers that unites to protect their common interest (which is to achieve their demands for better conditions at their work atmosphere). Even though, most trade unions are free (independent) of any employer, it also tries to develop close working relationships with employers. This may sometimes take the form of a partnership agreement between the employer and the trade union which identifies their common interests and objectives.
In the United States, trade unions go by the name labor unions. The union negotiates contracts and conditions with employers, keeping employee satisfaction high and protecting workers from unsafe or unfair working conditions.
While in Malaysia, restrictions imposed by the laws relating to trade unions are called Trade Unions Act 1959 (TUA) and the Industrial Relations Act 1967 (IRA) where TUA limited employees’ memberships to only those of a particular industry, establishment, trade and occupation and IRA allows employers to prohibit management, executives and those who work in a confidential and security capacity from joining a union.
