Ethical Issue in Business

Rules are always used in every style and gathering. Rules have been in place at the very start of life. The rules used generate from the express knowledge of man for what his or her needs and concerns are. The Government has implemented laws into the Constitution to enable the country to have knowledge of how the country is to operate. Those rules (Laws) change as society changes, and citizens can adjust the way they want to enforce them.

In today's society, law becomes an important role by helping maintain the social control within businesses, organizations, communities, and daily life. The law assists in protection and control of life. Disputes are resolved by the designed rules that will give citizens the knowledge of what is acceptable and what is not. People feel much safer after justice is served. The feel of protection by the removal of the non-conformer will leave the citizens at ease.

Large and small businesses need laws to keep their organization under control and prevent disruption. Laws are designed to protect the companies from lawsuits from their customers, suppliers, and vendors.

"Commercial law, also known as business law, is the body of law that applies to the rights, relations, and conduct of persons and businesses engaged in commerce, merchandising, trade, and sales," (October 2012). Business law protects and generates more sales because of the additional contracts and agreements by the mentioned customers, suppliers, and vendors. Keeping a business stable is difficult. These laws assist in keeping the business on track and agreements honored. The law assists when the agreement is not honored and falls through.

Sean Melvin discussed the case of Cipollone v. Liggett Group, Inc., where Cipollone filed a lawsuit against Liggett for a violation of several New Jersey consumer protection statutes. His alleged accusation was that, "Liggett (and other cigarette manufacturers) were liable for his mother's death because they engaged in a course of conduct including false advertising, fraudulently misrepresenting the hazards of smoking, and conspiracy to deprive the public of medical and scientific information about smoking," (Melvin, 2011, pg. 33).

Functions and Roles of Law

Hill defines Procedural Law as, "a law which establishes principles and creates and defines rights limitations under which society is governed, as differentiated from "procedural law," which sets the rules and methods employed to obtain one's rights and, in particular, how the courts are conducted," (Hill, 2005). Additionally, Hill menions that, "Substantive Law refers to the body of rules that determine the rights and obligations of individuals and collective bodies and Procedural Law is the body of legal rules that govern the process for determining the rights of parties," (Hill, 2005).

In the law dictionary Criminal Law is defined as, "certain behavior as illegal and lists the elements the government must prove to convict a person of a crime. In contrast, the rights of an accused person that are guaranteed by the Fourth, Fifth, and Sixth Amendments to the U.S. Constitution are part of a body of criminal procedural law," (Hill, 2005).
