a. Having visited BPJS Kesehatan website, I would like to focus on the program of BPJS Kesehatan as topic for further review and analysis. In principle, public service should be responsive towards expectation, preference and aspirations of public demand and then to be responsible in the context of adherence to existing regulations in providing public service to stay accountable. Previously before the existence of BPJS Kesehatan, government provide public service regarding social security by referring to Act No. 3/1992 regarding Labor Social Security Assurance and Government Regulation No. 14/1993 regarding the Implementation of Labor Social Security as revised by Government Regulation No. 1/2009 regarding sixth amendment of Government Regulation No. 14/1993 regarding the Implementation of Labor Social Security. As per chapter 6 Act No. 3/1992 jo. Chapter 2 clause (1) Government Regulation No. 14/1993 that labor social security program encompasses the obligation of business company to provide 4 (four) program, that is:

i. Labor workplace accident allowance;

ii. Death allowance;

iii. Retirement allowance and;

iv. Health insurance (selected as focus in this brief analysis).

For the first three are given in form of cash while health insurance is given in form of medical care services benefit. Referring to Government Regulation No.14/1993 that business organization which already employs 10 workers or more are qualified thus obliged to participate in the program managed by PT. Jamsostek back then. Whilst companies which already participate in private insurance or medical program that provides more comprehensive coverage of benefits and services of medical care to its employees are released from this obligation.

BPJS Kesehatan was formed by referring to Government Regulation No.24/2011 regarding Social Security Implementation Agency (Badan Penyelengggara Jaminan Sosial) that will carry out two main function that is ;
