Cyber Laws

Black’s Law Dictionary defines Cyber Law as, ‘The field of law dealing with the Internet, encompassing cases, statutes, regulations, and disputes that affect people and business interacting through computers.’ It further states, Cyber Law addresses issues of online speech and business that arise because of the nature of the medium, including intellectual property rights, free speech, privacy, e-commerce, and safety, as well as questions of jurisdiction.

It deals with the relationship of internet to technological and electronic element, including computers, software, hardware and information systems. 

Cyber law encompasses laws relating to:

  1. Electronic and Digital Signatures
  2. Offence relating to Computer
  3. Intellectual Property
  4. Data Protection and Privacy
  5. Telecommunications Laws

The Electronic Transactions Act, 2063 has defined following acts as an offence and has prescribed punishment:

  1. To pirate, destroy or alter computer source code.
  2. Unauthorized access in computer materials.
  3. Damage to any Computer and Information System.
  4. Publication of illegal materials in electronic form.
  5. To divulge or cause to divulge confidentiality of record, books, registers, correspondence, information, documents or materials to any unauthorized person.
  6. To commit computer fraud.

Similarly, Electronic Transactions Act, 2063 prescribes that a person who abets other to commit an offence relating to computer under this Act or who attempts or is involved in the conspiracy to commit such an offence and a person who assists others to commit any offence under this Act or acts as accomplice, by any means shall be liable for punishment.
